Former Agent Sues Kurt Busch, Claiming Unpaid Fees

Post by HiddenHollow »

DAYTONA BEACH, Fla. -- Kurt Busch is being sued by his former agent, who claims Busch owes him nearly $1 million in unpaid fees after terminating their deal about a year ago.

Sports Management Network, run by agent John Caponigro, filed the lawsuit earlier this month in U.S. District Court in Michigan. It claims it had an agreement with Busch through 2018 that required him to pay the agency 10 percent of his salary and personal services agreements.

Busch, who drives for Stewart-Haas Racing and has 28 career victories, terminated their relationship in March, according to the lawsuit, and SMN claims that Busch currently owes $930,450 and will owe an additional $540,000 that will be invoiced but is not yet due.

"We don't believe it is a meritorious lawsuit," Busch attorney Alan Miller said. "He plans to defend it very vigorously."

Caponigro's firm represents several drivers, including the Andretti family, Graham Rahal and Brad Keselowski, as well as coaches and media personalities. It began to represent Busch in 2005, a year after he won a Cup title.

The lawsuit was first reported by MLive.com.

Leave it up to Bob Pockrass to shove another driver under the bus. Couldn't he write another article about Danica? The article says that Kurt terminated the services of these leeches in March, yet they still want a piece of him!...SMH!

Kurt Busch Files Multimillion-dollar Countersuit vs. Sports Management Network

By Nate Ryan | Mar 24, 2017, 1:45 PM EDT

Kurt Busch filed a multimillion-dollar countersuit Friday against Sports Management Network, which sued the NASCAR driver last month for $1.4 million.

Busch is demanding a jury trial in the counterclaim lawsuit filed today in the U.S. District Court?s Eastern District of Michigan. The suit refutes the claims made by Sports Management Network that Busch was delinquent in his payments to the company since the second quarter of 2016.

Busch?s suit states that he maintained an attorney client-relationship with John Caponigro of Sports Management Network and the law firm of Frasco Caponigro Wineman & Scheible ?at all relevant times,? covering all matters and transactions related to Busch?s career.

Busch?s suit requests the court enter a judgment in his favor against SMN, FCWS and Caponigro for ?millions of dollars to be proven at trial plus all such other relief that the Court deems just and appropriate.?
