A U.S. District Court judge has ruled that the family of Kevin Ward Jr. can pursue all claims against Tony Stewart in the Aug. 2014 death of their son at Canandaigua (N.Y.) Motorsport Park. Judge David Hurd ruled that the Empire Super Sprints race would be considered a recreational activity under New York law, which means the waivers releasing liability signed by the 20-year-old Ward and his father (as the car owner) are not enforceable. On whether Ward suffered pre-impact terror or pain following being hit by Stewart's car, the judge ruled that is for the jury to determine.

This is a boat load of $&$&......excuse my French!!! Then why in the &$&$, do they force the drivers to sign them if they are not enforceable.....Another Judge who couldn't find his way out of a coat closet with an organized search party.....Where do they find these idiots..... :s_mad :s_mad :s_mad

You have to remember "It's New York" and they are no different than Nascar.
Make up new rules and laws as they see fit. :s_crazy :s_crazy

In the wrongful death lawsuit filed against Tony Stewart by the parents of Kevin Ward Jr., Stewart has filed a motion requesting an immediate appeal to a U.S. District Court judge's decision that liability waivers signed by drivers prior to the August 2014 sprint-car race were unenforceable. Stewart claims that he would eventually appeal the ruling (a trial is set for May) on this issue, and an appeals court decision prior to trial would help facilitate a potential settlement or impact the length of the trial. Stewart also argues that the decision creates "an immediate chilling effect on the continuation of" the racing industry in New York.

If the liability waivers are deemed unenforceable, then every driver and every track are at risk. It would change the whole complexion of racing.

I agree, this judge's ruling needs to be challenged.

Judges are only suppose to enforce laws, not write laws....SMH..
