Kevin Harvick is no longer set in the championship race in Miami after NASCAR penalized his team and took away his spot in the title race.

That means that there are three spots to be filled for the championship race Sunday in Phoenix.

NASCAR also docked Harvick 40 driver points and the team 40 car owner points. NASCAR suspended Kevin Harvick’s crew chief, Rodney Childers, for the rest of the playoffs after an issue with the team’s spoiler. NASCAR fined Childers $75,000, suspended him for the next two Cup races and suspended car chief Robert Smith two races. The team was docked 40 driver and car owner points.

Stewart-Haas Racing stated it would not appeal the penalty:

“We work tirelessly across every inch of our racecars to create speed and, unfortunately, NASCAR determined we ventured into an area not accommodated by its rule book. We will not appeal the penalty. Instead, we will direct our immediate focus to this weekend’s event in Phoenix and control our destiny on the racetrack.”

No. 4 Team Assessed L1-level Penalty, Docked 40 Points

By Staff Report | NASCAR.com | November 7, 2018 at 9:59 am

The No. 4 Stewart-Haas Racing team has been issued an L1-level penalty following driver Kevin Harvick’s win Sunday at Texas Motor Speedway, an infraction that carries major championship implications in the Monster Energy NASCAR Cup Series.

The team violated Section 20.4.12 of the NASCAR Rule Book that is specific to spoilers. Spoilers must be used exactly as supplied from the manufacturer and not altered. The infraction was discovered in post-race tear down at the NASCAR Research & Development Center.

As a result, Harvick has been docked 40 driver points and the team loses 40 owner points as well. Harvick’s win at Texas no longer automatically qualifies the team for the Championship 4 in Miami. He will enter this weekend’s Round of 8 finale fourth among eight playoff drivers in the standings, three points above the cutline – should there be a tie for the final transfer spot, Harvick cannot use the Texas win in the tiebreaking procedure.

Harvick Stripped Of Locked-in Finale Spot Over Illegal Spoiler

By: Jim Utter

Kevin Harvick has lost his locked-in status for the 2018 Monster Energy NASCAR Cup Series finale in Miami, and will be without his crew chief and car chief for the rest of the season.

NASCAR on Wednesday assessed Harvick and the No. 4 Stewart-Haas Racing team an L1 penalty after finding an unapproved spoiler on the car following its inspection this week at NASCAR’s R&D Center in Concord, N.C.

According to the penalty notice, “the vehicle spoiler must conform to the CAD file and drawing. Spoilers must be used exactly as supplied from the manufacturer.”

As a result, crew chief Rodney Childers has been fined $75,000 and suspended from the next to Cup races (in essence the remainder of the season). Car chief Robert Smith has also been suspended from the next two Cup series races.

In addition, the team has been docked 40 driver points and 40 owner points and Harvick’s win last weekend at Texas Motor Speedway can no longer be used to lock him in the Championship 4 series title race at Homestead, Fla.

In a statement, SHR said it would not appeal the penalty.

“We work tirelessly across every inch of our race cars to create speed and, unfortunately, NASCAR determined we ventured into an area not accommodated by its rule book,” said Greg Zipadelli, SHR’s vice president of competition.

“We will not appeal the penalty. Instead, we will direct our immediate focus to this weekend’s event in Phoenix and control our destiny on the race track.”

Tony Gibson will serve as Harvick’s interim crew chief the next two weeks and Nick DeFazio will serve as interim car chief.
