ya that in itself was a joke ( this has nothing to do with kurt ) i would have respected gene had he said " ryan just isnt performing the way i want." instead came up with a bs lie

Nature?s Bakery on Stewart-Haas lawsuit: ?Not going to let them bully us?

Reno, Nevada-based Nature?s Bakery, which was sued for $31.7 million earlier this month by Stewart-Haas Racing for alleged breach of contract, on Thursday publicly responded to the suit.

Nature?s Bakery was supposed to sponsor Danica Patrick?s No. 10 Monster Energy NASCAR Cup Series car for three years, but pulled out after just a single season on the car.

?Nature?s Bakery is in material breach of its contract with Stewart-Haas Racing,? the team said after filing its lawsuit. ?It is an unfortunate situation, as the team has delivered on all aspects of its contract and was prepared to do so again in 2017. Ultimately, this is a situation that will be resolved in a court of law.?

Not surprisingly, Nature?s Bakery in a statement Thursday had a different take on the suit.

?Following months of negotiations, Nature?s Bakery recently notified SHR that it could not continue the partnership due to several commercial and contractual issues during the 2016 race season,? the statement read in part.

?Nature?s Bakery is aware of SHR?s media campaign and recent false legal complaint. Those actions appear to have damaged SHR?s own business and unnecessarily drawn attention to SHR driver Danica Patrick. Contrary to SHR statements, Nature?s Bakery remains a healthy and vibrant company.?

The statement also quoted Nature?s Bakery CEO Kelly Allin.

?Contrary to its image, SHR is run by big-business types that took advantage of Nature?s Bakery. They now are threatening scorched earth litigation against a multi-generational family company,? said Allin. ?We?re obviously not going to let them bully us. We may be a small brand, but we do not think what they are doing is right. We look forward to defending ourselves in court.?

And it looks like they will have that opportunity.

From my experience with FRR, $400K for full sponsorship seems to be a low rate. There might have been a discount in exchange for purchasing for more Haas CNC
machines. However, Danica's performance dictates the cost of sponsorship. The going rate for a top rear quarter panel is about $5M per season.

UPDATE 2-25-2017: Nature's Bakery's counter claim to the breach of contract suit brought against it by Stewart-Haas Racing asserts that the NASCAR team "could not control" driver Danica Patrick as she promoted competing products on social media.

The response in North Carolina superior court claims that SHR had promised at least "four times return" on its annual $15.2 million investment from "Danica Patrick, a social media megastar with massive crossover appeal." Nature's Bakery products were to be the exclusive "on-the-go" food of Patrick and the team.

According to Nature's Bakery's response, "SHR could not control Patrick's performance, particularly as to her social media, which Patrick often refused to use to promote Nature's Bakery. Nor could SHR guarantee exclusivity for Nature's Bakery's brand in category of on-the-go foods because Patrick was already endorsing a protein bar made by one of Nature's Bakery's competitors, Six Star Pro Nutrition ("Six Star"). It was as if Michael Jordan decided to wear Adidas while being paid by Nike."

Nature's Bakery is full of crap. They don't even make a "protein bar." I double-checked their website this morning. If they can't tell the difference between a high-protein bar and a fig bar, no wonder they have some serious common-sense and financial problems. :roll:

Stewart-Haas Racing, Nature's Bakery tentatively settle lawsuit over Danica Patrick sponsorship

CHARLOTTE, N.C. -- Stewart-Haas Racing and Nature's Bakery have tentatively settled their lawsuit over the fig-bar company's dropping its sponsorship of Danica Patrick one year into a three-year deal.

Nature's Bakery informed SHR in January that it would not sponsor Patrick this season, and SHR filed a lawsuit in February asking for $31 million for the final two years of the deal. Nature's Bakery countersued, citing that SHR did not live up to its promises of support and that Patrick's endorsement of a protein bar violated the deal.

A document filed Wednesday in North Carolina Superior Court states that SHR's attorney has reported that the two sides "have executed settlement documents, which require certain deliverables within the next 21 business days." The order asks for a status report by June 23 if the two sides have not asked for the case to be dismissed.

Nature's Bakery sponsored Patrick for 28 races in 2016 and was scheduled for at least 25 in 2017. The team has picked up sponsorship, including six additional races from Aspen Dental, to fill some of the void.
